OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees a) On or about 05/08/2024, at a multi-employer construction site located at 870 SE 47th Terrace, Cape Coral, FL 33912, the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fall, struck-by and crushing hazards due to the operation of an UpRight UL-24 Platform Electric Lift, model number 62851-006, serial number 12793, at a height above 20 feet without the use of the four outriggers and not following the requirements of the manufacturer.
