29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift: (a) On or about August 7, 2024, employees painting the exterior of a commercial building from a Genie S-40 aerial lift, were not protected from an approximate 20-foot fall/thrown hazard on the north side of the building, by using a safety harness and lanyard attached to the lift. (b) On or about August 7, 2024, employees painting the exterior of a commercial building from a Genie S-40 aerial lift, were not protected from an approximate 13-foot fall/thrown hazard on the front west of the building, by using a safety harness and lanyard attached to the lift.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. (a) On or about August 7, 2024, employees painting the exterior of a commercial building from a Genie S-40 aerial lift, were not protected from an approximate 20-foot fall/thrown hazard on the north side of the building, and the employer did not ensure employees had not been trained on the hazards associated with scaffold work. (b) On or about August 7, 2024, employees painting the exterior of a commercial building from a Genie S-40 aerial lift, were not protected from an approximate 13-foot fall/thrown hazard on the west side of the building, and the employer did not ensure employees had not been trained on the hazards associated with scaffold work.
