OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operated a powered industrial truck while working from a platform exposed to fall hazards:  On or about August 7, 2024 an employee was exposed to fall hazards while working from a platform resting on the forks of the Yale Industrial Truck and the platform did not indicate the maximum work load including personnel and equipment, the weight of the empty platform, or the minimum capacity of the truck on which the platform could be used in accordance with ANSI B56.1-2012, American National Standard for Safety Standard for Low Lift and High Lift Trucks, Sections 4.17.2, 4.17.3, and 7.37.3.

29 CFR 1910.140(c)(12): The employer did not ensure that anchorages used to attach to personal fall protection equipment are independent of any anchorage used to suspend employees or platforms on which employees work. The employer did not ensure that anchorages used to attach to personal fall protection equipment on mobile work platforms on powered industrial trucks are attached to an overhead member of the platform, at a point located above and near the center of the platform.  On or about August 7, 2024, employees working from a platform on the Yale Industrial fork truck were exposed to fall hazards and the employer did not ensure that anchorages used to attach to personal fall protection equipment were independent of any anchorage used to suspend employees or platforms on which employees work.

29 CFR 1910.140(d)(2)(ii): The employer did not ensure that personal fall arrest systems were rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level. A free fall may be more than 6 feet (1.8 m) provided the employer can demonstrate the manufacturer designed the system to allow a free fall of more than 6 feet and tested the system to ensure a maximum arresting force of 1,800 pounds (8 kN) is not exceeded:  On or about August 7, 2024, employees were exposed to fall hazards when working from an elevated platform on a Yale Industrial fork truck and the employer did not ensure that personal fall arrest systems were rigged in such a manner that the employee cannot free fall more than 6 feet (1.8 m) or contact a lower level.
