(a) Nacho Salis DBA Nacho Salis failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected: Citation 1, Item 1 a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of August 29, 2024. Citation 1, Item 3 a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of September 18, 2024. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

(a) On or about August 7, 2024, at 10802 S. Shepard Ave, Oak Creek, WI 53154, the employer did not ensure employees conducting installation of a new residential roof, using hand tools and nail guns were wearing eye protection. This exposed the employees to struck by hazards and eye injuries.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b). (a) On or about August 7, 2024, at 10802 S. Shepard Ave, Oak Creek, WI 53154, employees installing a roof on an existing residential home roof with an approximately 8:12 pitch were not using fall protection. This exposed employees to a fall hazard of approximately 19 feet 11 inches from the roof eve to the ground below on the back (East) side of the home.
