The employer did not install guardrails or ensure employees utilized a fall protection system exposing the workers to fall hazards to the lower level.

29 CFR 1910.28(b)(11)(ii): Each flight of stairs having at least 3 treads and at least 4 risers is equipped with stair rail systems and handrails as follows: On or about August 7, 2024, Summit Portable Buildings LLC located at 7336 State Highway 32 in Farmington, Missouri, manufactured an elevated storage area approximately 8.5 feet above the ground. On the stairs used for access to the storage area the employer did not install handrails or stair rail systems on the three flights of stairs. Employees accessing this area to gather materials were exposed to fall hazards.

29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): On or about August 7, 2024, Summit Portable Buildings LLC located at 7336 State Highway 32 in Farmington, Missouri, was operating a Mitsubishi FD30N, Serial#: AF14E00308 and a Hyster 50, Serial#: L177B07553D powered industrial trucks. The employer did not remove the industrial trucks from service when conditions which affected safety were detected. The Mitsubishi industrial truck was noted to have a missing gas pedal, and a broken backup light. The Hyster 50 had a braking issue, no backup alarm, tires missing chunks or rubber and lacking tread. Employees were exposed to struck-by hazards.
