OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not protected from the hazard of high heat while performing job duties.   a) On or about August 6, 2024, at 2714 S. West Main, Jeanerette, LA 70544, employees were exposed to the hazard of high heat from working under direct sunlight during the performance of their job duties, which included planting sugar cane. Employees performing moderate manual labor were exposed to temperatures of 99 degrees F with relative humidify levels ranging from 42  to 72 percent, and heat index of 109 degrees F, and the calculated Wet Bulb Globe Temperature (WBGT) between 7:00AM and 5:00PM ranged from approximately 82 degrees F to- 90 degrees F.    Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, a heat stroke.
