29 CFR 1928.51(b)(2)(i)(A): Where ROPS were required by this section, the employer did not provide each tractor with a seatbelt which meets the requirements of this paragraph: (a) On or about August 7, 2024, and at times prior to, at Farm 1, 27600 Southwest 217th Avenue, Homestead, FL 33031, the employer kept in operation the Kubota MX5000 No 15 tractor without a seatbelt installed, exposing workers to struck-by and crush hazards.

(a) On or about August 7, 2024, and at times prior to, at Farm 1, 27600 Southwest 217th Avenue, Homestead, FL 33031, the employer did not ensure that operators of the Kubota B7510 No 7 used the seatbelt while the tractor was moving to prevent exposure to struck-by and crush hazards. (b) On or about August 7, 2024, and at times prior to, at Farm 2, the employer did not ensure that operators of the Kubota B2401 No 35 used the seatbelt while the tractor was moving to prevent exposure to struck-by and crush hazards.
