29 CFR 1926.453(b)(2)(v): A safety harness with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:  a) On or about 8/7/2024 at a construction project located at 310 Ship Canal Parkway, Buffalo, New York; employees were installing hangers for conduit and cable runs. The employees were using a boom lift to access work areas above the previously installed duct work. The employees in the lifts did not have a harnesses with lanyards attached to the boom or basket and were exposed to a 20 feet fall.  ABATEMENT CERTIFICATION REQUIRED

29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of aerial lift being used and to understand the procedures to control or minimize those hazards:  a) On or about 8/7/2024 at a construction project located at 310 Ship Canal Parkway, Buffalo, New York; employees were using a boom lift to access work areas while installing hangers for conduit and cable runs. An employee was using the lift without fall protection and at times standing on the midrail while working. The employees were not trained in the proper use and operation of the boom lift in use.
