29 CFR 1926.453(b)(2)(v): A body belt was not and a lanyard attached to the boom or basket when working from an aerial lift: a) Job site, 3506 Forbes Avenue, Pittsburgh, PA: On or about August 9, 2024, during construction activities, the employer did not ensure that employees used appropriate fall protection systems/devices when working in an aerial lift several stories high up in the air. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.20(b)(2): A program of frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers was not in use: a) Job site, 3506 Forbes Avenue, Pittsburgh, PA: On or about August 9, 2024, during construction activities, the employer did not ensure that a system was implemented at the job site to identify and correct safety and health issues. Deficiencies noted during the inspection included, but were not limited to, failing to wear fall protection while in an aerial lift while working several stories in the air, ground supported scaffolding planking that was blocked up between levels by multiple boards and using shock absorbing lanyards in an aerial lift to get up/down to and from the ground supported scaffold, a height of approximately 8 to 9 feet.
