29 CFR 1910.1025(l)(1)(i) as required by 1960.8(b): Employee(s) working in an area where there is potential exposure to airborne lead at any level were not informed of the content of Appendices A and B of 29 CFR 1910.1025: a) U.S. Customs and Border Protection, 45764 Landon Road, Wellesley Island, NY 13640, on or about 8/14/2024; Employees had a potential for exposure to lead while shooting leaded ammunition for qualifications and the employer did not inform the employees of the content of Appendices A and B of the lead standard. Employees were exposed to potential airborne and ingestion hazards that could result in the health effects such as kidney disease, and impairment of the nervous system and reproductive system. Abatement certification is required.

29 CFR 1960.27(a) The Agency's safety and health inspectors in charge of inspections did not give a representative of employees an opportunity to accompany Safety and Health Inspectors during the physical inspection of any workplace, both to aid the inspection and to provide such representatives with more detailed knowledge of any existing or potential unsafe or unhealthful working conditions. a) U.S. Customs and Border Protection, 45764 Landon Road, Wellesley Island, NY 13640, on or about 8/1/2024; The Agency's safety and health inspectors in charge of inspections completed Safety and Health Inspection on a monthly and annual frequency and did not give a representative of employees, Union President of Local 2724, an opportunity to attend the physical inspections of the workplace. Abatement certification is required.

29 CFR 1910.1025(m)(1)(iii) as required by 1960.8(b): The employer did not include lead in the hazard communication program established to comply with the hazard communication standard (1910.1200). a) U.S. Customs and Border Protection, 45764 Landon Road, Wellesley Island, NY 13640, on or about 8/14/2024; The employer did not ensure lead was included in the hazard communication program and did not provide employees information and training on the hazards of lead and the measures they can take to protect themselves when shooting and cleaning firearms. Employees were exposed to potential airborne and ingestion hazards that could result in the health effects such as kidney disease, and impairment of the nervous system and reproductive system. Department of Homeland Security dba U.S. Customs and Border Protection was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.1025(m)(1)(iii), which was contained in OSHA Inspection 1647395, citation number 1 item number 1b and affirmed as a final order on 7/10/2023, with respect to a workplace located at 2321 Pine Grove Ave, Port Huron, MI 48060.
