29 CFR  1910.133(a)(1):Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:  a)	Portland Cement Mixing Building and Production Buildings:  On or about August 14, 2024, and at times prior to, the employer exposed employees to chemical burn and flying particles hazards from working with corrosive Portland Cement solids and dusts during casting and breakdown of pavers work tasks and did not ensure or require employees to wear face or eye protection.  b)	Shipping Area:  On or about August 14, 2024, and at times prior to, the employer exposed employees flying particles hazards from working with hammer and nail and pneumatic nail gun during pallet making work tasks and did not ensure or require employees to wear face or eye protection.

29 CFR  1910.136(a):General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, and where such employee's feet are exposed to electrical hazards  a)	Production Areas:  On or about August 14, 2024, and at times prior to, the employer exposed employees to struck by hazards by not ensuring and requiring protective footwear be worn when lifting pavers by hand and carrying them up to approximately 10 feet of horizontal travel.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  a)	Small Barrel Mixing Building:  On or about August 14, 2024, and at times prior to, the employer did not ensure all secondary containers were labeled with contents and hazard of chemical in a 55-gallon drum containing product used by the mixing operator.  b)	Portland Cement Mixing Building:  On or about August 14, and at times prior to, the employer did not ensure all secondary containers were labeled with contents and hazard of chemical in a 35 fl. oz. spray bottle to include cleaning product used by the mixer operator.  c)	Production Building and Yard Area:  On or about August 15, 2024, and at times prior to, the employer did not ensure all secondary containers were labeled with the hazards of chemical in 1-gallon hand sprayers  to include Form Oil used by production employees.
