On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, an employee was exposed to a potential struck-by hazard working below a power tool which was hung from a roof ridge board without using head protection.

29 CFR  1926.102(a)(1):  The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, an employee was exposed to potential struck-by hazards operating a pneumatic nail gun without using eye protection.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  a)  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a fall hazard working from a second floor with unprotected edges 10.5 feet above the inside lower surface level without using required fall protection equipment.  b)  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a fall hazard working from a second floor with unprotected edges 12.5 feet above the outside surface level without using required fall protection equipment.  c)  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a fall hazard walking on a second floor in area of top landing of a stairway with unprotected edges 10.5 feet above the first floor.  Employees were using the stairway to access the second floor.    d)  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a fall hazard working from a second floor with an unprotected exterior wall opening with the bottom outside edge 15 feet above surface level and inside edge 25 inches above the walking surface without using required fall protection equipment.

29 CFR  1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.   On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, the employer did not provide required fall protection safety training for employees working at heights greater than six feet.  Employees were framing a two-story house with unprotected second floor wall opening and walking surface edges.

29 CFR  1926.1051(a)(3):  Stairways and Ladders.  General requirements.  When a building or structure has only one point of access between levels, that point of access shall be kept clear to permit free passage of employees.  When work must be performed or equipment must be used such that free passage at that point of access is restricted, a second point of access shall be provided and used.   On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a potential fall hazard using an access/egress stairway between a first floor and a second floor with a trip hazard at the top of the stairway.  Framing materials were placed on the top landing and over the top edge above the steps.

Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with at least one handrail.  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, employees were exposed to a potential fall hazard using an access/egress stairway between a first floor and a second floor without a handrail installed.  Second floor was 10.5 feet above the first floor.

The employer shall ensure that each employee has been trained by a competent person in the nature of fall hazards in the work area.  On or about August 14, 2024, at W7017 Crestfield Way in Greenville, Wisconsin, the employer did not provide required stairway safety training for employees using an access/egress stairway between a first floor and a second floor.  Employees using stairway without the top landing clear of trip hazards and without a handrail installed.
