29 CFR 1910.141(a)(5):Enclosed workplaces were not so constructed, equipped, and maintained as to prevent the entrance or harborage of rodents, insects, or other vermin: Employees are exposed to potential infectious disease due to vermin/insect infestation in the workplace. This was most recently documented on or about August 12, 2024 at 2700 Diers Parkway, Fremont, Nebraska. Vermin were found in large numbers in the party room of the diner. Insects enter the facility through the party room and were found on and near the tables.

29 CFR 1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. Employees are exposed to chemical hazards. This was most recently documented on or about August 12, 2024 at 2700 Diers Parkway, Fremont, Nebraska. Employees are using unlabeled spray bottle containers of chemicals including but not limited to: Ecolab Greaselift, Degreaser, Ecolab Sanitizing Wash N Walk, and Ecolab Greasecutter Plus.
