29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about August 13, 2024, at a jobsite located at SR 534 & SR 307 Geneva OH 44041, the employer did not ensure adequate cave-in protection was used to protect an employee installing a water line in a trench with near vertical side walls and a depth of approximately 11ft. Klinginsmith Enterprises, Inc was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number #1613744, citation number 1, item number 1 and was affirmed as a final order on 1/10/2023, with respect to a workplace located at 3019 Hampshire Rd., Erie, PA.
