29 CFR  1926.451(a)(6):Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  a.) On or about August 12, 2024, the employer failed to ensure that scaffolds were designed and constructed by a qualified person. Employees were hoisted to the roof using a fabricated scaffold attachment on an all-terrain forklift that was not designed by a qualified person. As a result, employees were exposed to fall hazards at heights of 22 feet, 10.5 inches.

29 CFR  1926.451(c)(2)(iv):Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use.  a.) On or about August 12, 2024, the employer failed to ensure that a scaffold platform attached to an all-terrain forklift was specifically designed by the manufacturer for such use. As a result, employees were exposed to fall hazards at heights of 22 feet, 10.5 inches.

29 CFR  1926.451(f)(3): Scaffolds and scaffold components shall be inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity.  a.)	On or about August 7, 2024, the employer failed to ensure that scaffolds and scaffold components were inspected for visible defects by a competent person before the work shift in that, the scaffold used by an employee had visible defects: missing guardrails on multiple sides, inadequate tie-off points for fall protection, and a visibly damaged platform board. These defects exposed the employee to fall hazards, resulting in the employee falling 22 feet, 10.5 inches to a concrete floor below.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.   a.) On or about August 12, 2024, the employer failed to ensure that employees were protected from fall hazards while they installed metal roof panels on a new building structure using a scaffold. Employees were exposed to fall hazards of 22 feet, and 10.5 inches while working on a roof without adequate fall protection.

29 CFR  1926.602(c)(1)(viii):Whenever a truck is equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, the following additional precautions shall be taken for the protection of personnel being elevated. ?	1926.602(c)(1)(viii)(A) Use of a safety platform firmly secured to the lifting carriage and/or forks. ?	1926.602(c)(1)(viii)(B) Means shall be provided whereby personnel on the platform can shut off power to the truck. ?	1926.602(c)(1)(viii)(C) Such protection from falling objects as indicated necessary by the operating conditions shall be provided.   a)	On or about August 7, 2024, the employer failed to ensure the required safety precautions were taken while using a CAT all-terrain material handler to elevate personnel in that a non-manufacturer-approved fabricated platform was used and was not firmly secured to the lifting carriage or forks, and personnel on the platform were not provided with a means to shut off power to the truck. As a result, employees were exposed to a fall hazard of 22 feet, 10.5 inches.

29 CFR 1904.39(a)(2): Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a.) On or about August 7, 2024, the employer failed to report the in-patient hospitalization of an employee to OSHA within 24 hours of the incident.
