29 CFR  1926.102(a)(2):The employer did not ensure that each affected employee used eye protection that provided side protection when there is a hazard from flying objects.   (a) 450 Waupelani Drive, State College, PA, Embassy of Hearthside, - Employees did not don safety glasses while using pneumatic nail guns to attach shingles to the roof of a one-story commercial building and were exposed to flying debris and ricochet nails, on or about August 16, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) 450 Waupelani Drive, State College, PA,  Embassy of Hearthside, - Employees were installing shingles on the roof of a one story commercial  building at 6:12 pitch and were not trained in appropriate fall protection methods to avoid hazards associated with elevated work areas, on or about August 16, 2024.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR  1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) 450 Waupelani Drive, State College, PA, Embassy of Hearthside Roof - Employees were performing commercial roofing operations on a three story apartment building roof,  the portable extension ladder did not extend 3 feet above the upper landing, on or about August 16, 2024.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.501(b)(11):  Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:  (a) 450 Waupelani Drive, State College, PA,  Embassy of Hearthside - Employees were installing new roof shingles approximately 8.5 feet above grade on a 6:12 pitch roof without a fall protection system in place, on or about August 16, 2024.   The Fast Enterprise Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1690665, citation number 1, item number 1, and was affirmed as a final order on October 11, 2023, with respect to a workplace located at 521 Clearview Drive, Hollidaysburg, PA 16648.  The Fast Enterprise Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1610479, citation number 1, item number 1, and was affirmed as a final order on December 28, 2022, with respect to a workplace located at 24-26 S River Street, Lewisburg, PA 17837.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
