OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of high heat while performing job duties.  On or about August 1, 2024, employees of United States Postal Service performing mail delivery were exposed to the hazard of high ambient heat including high outdoor temperature, humidity and direct sun exposure during the performance of their duties, which included delivering mail to mixed business, residential, curbside motorized routes and foot routes.  On August 01, 2024 a maximum temperature of 102�F, average temperature 90�F was reported by the National Oceanic and Atmospheric Administration (NOOA). The heat index ranged from 81�F to 97�F. Such exposures are likely to lead to the development of serious-related illnesses such as, but not limited to heat cramps, heat stress, heat exhaustion, heat stroke and death.

29 CFR  1904.7(a): The employer did not record workplace injuries and illnesses that would be considered to meet the general recording criteria, and therefore to be recordable, if it results in any of the following: death, days away from work, restricted work or transfer to another job, medical treatment beyond first aid, or loss of consciousness. You must also consider a case to meet the general recording criteria if it involves a significant injury or illness diagnosed by a physician or other licensed health care professional, even if it does not result in death, days away from work, restricted work or job transfer, medical treatment beyond first aid, or loss of consciousness.   On or about August 19, 2024, the employer failed to record an employee incident on August 1, 2024 that resulted in medical treatment beyond first aid and days away from work on the OSHA 300 log.

29 CFR  1904.32(b)(3): A company executive did not certify that he or she has examined the OSHA 300 Log and that he or she reasonably believes, based on his or her knowledge of the process by which the information was recorded, that the annual summary is correct and complete:  On or about August 19, 2024, for calendar year 2021 and 2022 the employer did not certify and sign the OSHA Form 300A Summary of Work-Related Injuries and Illnesses by a company executive.
