OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards associated with inadequately maintained racking systems:  a) Between bays M-009-2 and M-011-2, Section M - On or about August 19, 2024, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets on a damaged steel racking system that had bent upright columns.   b) End of bay O-001-1, Section O - On or about August 19, 2024, employees were exposed to overhead struck-by hazards caused by falling objects and rack collapses in that they were required to use powered industrial trucks to handle pallets on a damaged steel racking system that had bent upright columns.   Certification Not Required.

29 CFR 1910.140(d)(1)(iv):  The employer did not ensure that personal fall arrest systems sustain the employee within the system/strap configuration without making contact with the employee's neck and chin area:  a) Facility Wide - On or about August 19, 2024, employees were required to use a personal fall arrest system when operating order pickers and were exposed to a fall hazard of approximately twenty-three (23) feet because the employer did not ensure that the full-body harness were properly sized so the strap would not make contact with the employee's neck and chin area if a fall occurred.  Certification Not Required.

29 CFR 1910.140(c)(6): The employer did not ensure that a competent person or qualified person inspected each knot in a lanyard or vertical lifeline to ensure that it meet the requirements of paragraphs 29 CFR 1910.140(c)(4) and (5) before any employee used the lanyard or lifeline:  a) Facility Wide - On or about August 19, 2024, employees were required to use a personal fall arrest system when operating order pickers and were exposed to a fall hazard of approximately twenty-three (23) feet because a knot in the lanyard being used had not been inspected by a competent person.
