29 CFR  1910.151(c):Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) Pool maintenance room: On or about August 19, 2024, at times prior, employees were exposed to corrosive chemicals which can cause eye damage. The employer failed to provide adequate eyewash stations throughout the facility where corrosive chemicals are regularly handled and utilized. Per the Aqua Guard Brominating Tablets Safety Data Sheet, "Immediately flush with plenty of water. After initial flushing, remove any contact lenses and continue flushing for at least 15 minutes. Keep eye wide open while rinsing. If symptoms persist, call a physician." Aqua Guard Brominating Tablets are classified as a Category 1 Corrosive (in reference to Table A.3.2 from 29 CFR 1910.1200 Appendix A). There were no areas within close proximity for employees to flush eyes in case of contact as the eyewash stations that were available at the time were present but not operational.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:   a)  On or about August 19, 2024, and at times prior, employees were exposed to corrosive, carcinogenic, and flammable chemicals (e.g. gasoline, Aqua Guard brominating tablets, soda ash, chlorine, and muriatic acid). The employer did not provide or implement a written hazard communication program at this location as required.  Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   a) On or about August 19, 2024, and at times prior, employees were exposed to corrosive, carcinogenic, and flammable chemicals (e.g. gasoline, Aqua Guard brominating tablets, soda ash, chlorine, and muriatic acid). The employer did not provide job-specific training as required to their employees, including but not limited to what hazardous chemicals are utilized and the dangers the chemicals present. 29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  a) Pool maintenance room: On or about August 19, 2024, and at times prior, employees were exposed to corrosive chemicals which can cause eye or skin damage. The employer failed to provide goggles and chemical gloves. Per the Aqua Guard Brominating Tablets Safety Data Sheet, "Avoid contact with skin, eyes or clothing. Use personal protective equipment as required. Ensure adequate ventilation, especially in confined areas. Wear protective gloves and protective clothing. Wear safety glasses with side shields (or goggles)." Aqua Guard Brominating Tablets are classified as a Category 1 Corrosive (in reference to Table A.3.2 from 29 CFR 1910.1200 Appendix A).

29 CFR  1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  a) Pool maintenance or pool chemical handling at 10200 Park Meadows Dr, Littleton, CO 80124: On or about August 19, 2024, and at times prior, facilities maintenance employees were exposed to inhalation hazards due to the employer not providing the information contained in Appendix D to 29 CFR 1910.134. The facility allows a voluntary respirator use when performing tasks such as pool chemical maintenance, but the employees were not notified of respirator precautions to ensure the respirator itself did not present a hazard.
