OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards from powdered metal press deficiencies: A.) MPP Holdings, LLC DBA Proform Powdered Metals, on or about 8/17/24 and times prior thereto: Various powdered metal presses used for compacting powdered metal into parts and sizing metal into parts had deficiencies. These deficiencies included but were not limited to, Press keys were left in the machine, which allowed employees to change the mode of the machine. Keys were not designated for authorized employees/supervisors. All employees could change the mode of the press, presses include but is not limited to, Gasbarre Sizer 45B Serial No 20011168 B.) MPP Holdings, LLC DBA Proform Powdered Metals, on or about 8/17/24 and times prior thereto: Various powdered metal presses used for compacting powdered metal into parts and sizing metal into parts had deficiencies. These deficiencies included but were not limited to, Break Monitor keys were attached to the break monitor, which allow employees to reset alarm conditions and/or put the unit into set up mode. Keys were not designated and held by authorized personal. All employees could reset alarm conditions and put the unit into setup mode. Powdered metal presses include but is not limited to, Gasbarre Sizer 45B Serial No 20011168 C.) MPP Holdings, LLC DBA Proform Powdered Metals, on or about 8/17/24 and times prior thereto: Various powdered metal presses used for compacting powdered metal into parts and sizing metal into parts had deficiencies. These deficiencies included but were not limited to, employees reset the Gordon Brake Monitor without clearing the fault. Powdered metal presses include but is not limited to, Gasbarre Sizer 45B Serial No 20011168 ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
