29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a) On or before August 20, 2024, the employer did not ensure that each employee removing a damaged sewer line inside the excavation located in the street (W. Alkire Ct.) was provided with a safe means of access / egress. A stairway, ladder, ramp or other safe means of access / egress was not provided to employees that worked in the excavation that was 19.5 feet in depth, 20 feet in width, and greater than 35 feet in length.  This condition did not provide employees with a safe means of trench egress.

29 CFR 1926.651(e): The employer did not prohibit an employee from being underneath loads handled by lifting or digging equipment:  (a) On or before August 20, 2024, the employer did not ensure that each employee who was within the excavation and was receiving material for installation was not protected from overhead hazards.   Employees were exposed to struck-by hazards due to sections of pipe being lowered into the excavation with an excavator above them.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a) On or before August 20, 2024, and at times prior, the employer did not ensure that daily inspections were made to ensure that the excavation, located in the street (W. Alkire Ct.) was safe.  The excavation measured approximately 19.5 feet in depth, 20 feet wide and 35 feet long. There was an 8-foot by 16-foot Speed Shoring protective shield installed in the excavation. The installation would have allowed lateral movement of the box if there was a cave in. The competent person did not identify the lack of an appropriate protective system or did not take prompt corrective action to eliminate the cave-in hazard. The type B soil in the excavation had visible cracks and fissures in addition to sections of soil sluffing off into the excavation. This condition exposed employees to a crushing hazard by excavation wall cave-in.

29 CFR 1926.652(g)(1)(ii): Shields were not installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads:  (a) On or before August 20, 2024, and at times prior, the employer did not ensure that each employee removing a damaged sewer line inside the excavation located in the street (W. Alkire Ct.) was safe.  An 8-foot by 16-foot Speed Shoring protective shield, was installed in the excavation, that measured approximately 19.5 feet in depth, 20 feet and 35 feet long.  The shield was not installed so as to prevent lateral loads from compromising the protective capacity of the shield system, in that a gap of approximately 3 feet on the west side and 2 feet on the east side existed between the shield and the excavation walls. There were two 8-foot by 16-foot-long trench boxes stacked. The top box was installed up-side down. This condition exposed employees to crushing hazards from cave-in due to protective system failure.
