OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On or about August 21, 2024, located at 150 Read Street, Portland Maine - In the following instances the employees were exposed to struck by hazards due to broken and damaged warehouse racking supports. Instance a - Racking leg at end of aisle 23 near 23A09 Instance b - Broken racking leg located at 20A19 Instance c - Broken racking leg located at 12A22 Instance d - Broken and bent racking leg located at 11K24 Instance e - Bent and not properly secured racking leg located at 11K38. The bolt appears to have been pulled out of the concrete floor.

29 CFR 1910.176(b): Stored material was not stacked, blocked, interlocked, or limited in height so that it was stable and secure against sliding and collapse: Throughout the warehouse, in the following instances, boxes, pallets, and packages were not stacked in a stable and secure manner to prevent possible collapse or sliding. Instance a - 3P Black unpadded 400ct foam trays located at back of warehouse. Instance b - Pallet not properly positioned on warehouse racking located next to 22A40, 2nd tier. Instance c - Double stacked pallets tipping over at the end of the first aisle. Instance e - Yellow foam trays stacked nearly to the ceiling. Instance f - Various products in boxes collapsed along the backwall of the warehouse Instance g - Pallet of boxes with a product box over hanging located near 13K33 top tier. Instance h - Pallet of boxes shoved into the warehouse racking and slide the top layer of boxes off. The boxes are being held in place by the plastic wrap. Located at 12L38.

Warehouse - The Crown stand-up Powered Industrial Truck did not have its forks completely lowered, nor was it turned off while the operator was on lunch.
