The mobile platform used to access and egress the platform.

29 CFR 1910.28(b)(1)(i):(1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the items identified in 1910.28(b)(1)(i)(A)-1910.28(b)(1)(i)(C). On or about August 21, 2024, with respect to an establishment located at 301 Bridge St, Green Bay, WI 54303, employees conducting production activities from a platform next to the Pursuit Tank were not adequately protected from falls of greater than five feet. The opening used for accessing the platform was wider than the mobile platform used to climb to the platform and would have allowed an employee to fall down the side of the mobile platform.

29 CFR 1910.29(b)(1):(1) The top edge height of top rails, or equivalent guardrail system members, are 42 inches (107 cm), plus or minus 3 inches (8 cm), above the walking-working surface. The top edge height may exceed 45 inches (114 cm), provided the guardrail system meets all other criteria of paragraph (b) of this section (see Figure D-11). On or about August 21, 2024, with respect to an establishment located at 301 Bridge St, Green Bay, WI 54303, employees conducting production activities from a platform next to the Pursuit Tank were not adequately protected from falls of greater than five feet with the top rail of the guardrail system was located at 59 inches above the working surface. Because of the height of the top rail, the space between the working surface, mid rail and top rail were greatly expanded and increased the probability that an employee would fall through the guardrail system, instead of against it.

29 CFR 1910.212(a)(3)(ii):The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle. On or about August 7, 2024, with respect to an establishment located at 301 Bridge St, Green Bay, WI 54303, employees in the maintenance area were exposed to potential struck-by hazards during cutting operations while using a Contractor Table Saw. The saw was not equipped with a hood guard to prevent access to the unused portion of the blade.
