1926.652(c)(2)(ii) Deviation from the specifications, recommendations, and limitations issued or made by the manufacturer shall only be allowed after the manufacturer issues specific written approval. On or about August 22, 2024, during the replacement of a waterline and street rehabilitation project at a worksite located at the corner of East 30th Street and Payne Avenue, Cleveland, Ohio, the employer failed to ensure an employee working inside a trench with a varying depth of approximately 6 to 6.5 feet, was protected from cave-ins by a protection system. The employee was working outside the trench shield (box) cave-in protection system to install a collar on a waterline pipe.

29 CFR 1926.652(g)(1)(iii):Employees shall be protected from the hazard of cave-ins when entering or exiting the areas protected by shields. On or about August 22, 2024, during the replacement of a waterline and street rehabilitation project at a worksite located at the corner of East 30th Street and Payne Avenue, Cleveland, Ohio, the employer failed to ensure an employee working inside a trench with a varying depth of approximately 6 to 6.5 feet, was protected from cave-ins when entering or exiting the area of the trench protected by two trench shields (boxes). An extension ladder was located at the eastern end of the trench and the employee was working in the western most end of the trench and had to enter and exit the two trench boxes inside the trench to access and egress from the ladder to the work area.
