Citation 1, Item 3 a serious  violation of 1926.300(b)(2)) with an abatement date of February 12, 2025.  Citation 1, Item 4 a serious  violation of 1926.503(a)(1)with an abatement date of February 12, 2025.  Citation 1, Item 3 a repeat violation of 1926.20(b)(2) with an abatement date of February 12, 2025.  Citation 1, Item 3 a repeat violation of 1926.501(b)(13) with an abatement date of February 12, 2025. OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards:   On or about August 22, 2024, at a job site located at 9279 South Arbor Creek Drive, Oak Creek, WI 53154, an employee was exposed to a fall hazard of approximately 12 feet while using the load area surface of an Equipter RB4000, as a means of access to install shingles on an existing residential roof.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation  (a) On or about August 22 , 2024, employees were operating pneumatic nail guns without eye protection while installing shingles on existing residential roof, exposing the employees to a struck by / eye injury hazard.

29 CFR 1926.300(b)(2):  Belts, gears, shafts, pulleys, sprockets, spindles, drums, fly wheels, chains, or other reciprocating, rotating or moving parts of equipment shall be guarded if such parts are exposed to contact by employees or otherwise create a hazard. Guarding shall meet the requirements as set forth in American National Standards Institute, B15.1-1953 (R1958), Safety Code for Mechanical Power-Transmission Apparatus.  (a) On or about August 22, 2024, employee(s) used an extension ladder hoist to convey materials up to the roof. The hoist did not have the power transmission pulley and belt guarded, exposing employees to a caught-in hazard and amputation hazard.

(b) On or about August 22, 2024, employee installing shingles on an existing residential home, used a Gorilla Aluminum adjustable ladder to access the Equipter RB4000 dump trailer that was not erected three (3) feet above the upper landing.

29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about August 22, 2024, the employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure fall protection was being worn, that fall protection systems were installed properly, that ladders were installed properly, Personal Protective Equipment was being worn, that the Equipter RB4000 dump trailer was used as intended, and that job site conditions were maintained safe.  The Jose N Alvarado Service LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 1669897, citation number 1, item number 1 and was affirmed as a final order on July 14, 2023, with respect to a workplace located at 3849 Heather Valley Road in Sheboygan, WI 53083.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about August 22, 2024, employees conducting roofing work on a 10:12 pitched, on the east side of a residential home were not tied off. This exposed employees to a fall hazard of approximately 11 feet from roof to the ground below.  The Jose N Alvarado Service LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 1669897, citation number 1, item number 2, and was affirmed as a final order on July 14, 2023, with respect to a workplace located at 3849 Heather Valley Road in Sheboygan, WI 53083.
