29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a) On August 21, 2024, and at times prior thereto, employees worked in an excavation of type B soil to install a new plumbing service line. The excavation measured between 8 1/2 and 9-feet in depth, 27 - 37 inches wide, and approximately 45 feet long. Employees did not recognize the hazards of working outside of the cave-in protection that was provided and did not recognize that the shoring system was not installed in accordance with the tabulated data.
