29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about August 21, 2024, and at times prior thereto, employees engaged in applying roofing materials were not provided fall protection exposing employees to an unprotected fall hazard of approximately 24 feet to the ground below.  Cristian Merino was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1714390, citation number 1, item number 2 and was affirmed as a final order on March 7, 2024, with respect to a workplace located at 1611 Crestfallen Dr., Forney TX 75126.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   On or about August 21, 2024, and at times prior thereto, at the jobsite, employee(s) performed roofing work without being provided hazard recognition and avoidance formal training.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  On or about August 21, 2024, and at times prior thereto, the employer did not ensure employees safely used the ladder to gain access to the residential roof.  The ladder was not secured at the top and did not extend three feet above the landing surface. Employees were exposed to a fall hazard of approximately 16 feet.  Cristian Merino was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1714390, citation number 1, item number 3 and was affirmed as a final order on March 7, 2024, with respect to a workplace located at 1611 Crestfallen Dr., Forney TX 75126.
