29 CFR  1926.95(d)(1): Except as provided by paragraphs (d)(2) through (d)(6) of this section, the protective equipment, including personal protective equipment (PPE), used to comply with this part, was not provided by the employer at no cost to employee(s).   a. On or about August 26, 2024, at Lot 1: the employer did not provide the necessary PPE at no cost to the employees (fall, eye and head protection) while conducting roofing activities, exposing employees to eye injury, falls and struck by hazards. Employees purchased their own personal protective equipment.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  a. On or about August 26, 2024, at Lot 1: employees were exposed to 14 foot 7 inch fall hazards while decking on a 5/12 pitched roof, in that a fall protection system was not used.  b. On or about August 26, 2024, at Lot 1: employees were exposed to 9 foot 10 inch  fall hazards while decking on a 5/12 pitched roof, in that a fall protection system was not used.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a. On or about August 26, 2024, at Lot 1: employees were exposed to a 10 foot fall hazard, in that a multi-position ladder was used extended approximately 10 inches above the landing to access a 5/12 pitch residential roof.

On or about August 26, 2024, at Lot 1: the employer did not prepare and maintain a written fall protection training certification for employees exposed to fall hazards of 9 feet 10 inches while working on the roof.
