OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by and struck-by hazards: a) Worksite, Parking Lot Presidential Park Elementary School: On or about August 16, 2024, an employee was repositioning a Casagrande B175 XP-2 (Serial Number B175UN0267) piling rig off of wooded mats with the mast in the full upright position. The piling rig was not on plane and level ground and tipped over.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) Worksite, Parking Lot Presidential Park Elementary School: On or about August 16, 2024, an employee was using 12'x6' wooden mats to protect the asphalt from the Casagrande B175 XP-2 (Serial Number B175UN0267) Piling Rig and was not instructed in the recognition and avoidance of unsafe conditions in that the wooden mats were unable to withstand the weight of the Casagrande B175.
