29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about August 28, 2024, at a jobsite located at 2135 E Belmont Place Oak Creek, WI 53154, employees were operating pneumatic nail guns without  eye protection while installing roof shingles. This exposed employees to struck-by and eye impalement hazards.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  (a) On or about August 28, 2024, at a jobsite located at 2135 E Belmont Place Oak Creek, WI 53154, three of the portable ladders being used to access the roof of the structure did not extend at least three feet above the upper point of contact with the roof nor were the ladders secured in place. This exposed employees using the ladders to a fall hazard of approximately  10.3 feet onto concrete while accessing the roof.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) On or about August 28, 2024, at a jobsite located at 2135 E Belmont Place Oak Creek, WI 53154, employees conducting roofing activities (shingle installation) on the 10:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard from the roof of approximately 10.3 feet on the East side of the structure and 19 feet on the North side at the walkout basement.  Octavio's Home Improvement LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1687513, citation number 1, item number 1 and was affirmed as a final order on October 20, 2023, with respect to a workplace located at 1055 Huron Way, Hartford, WI 53027.  Octavio's Home Improvement LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1669894, citation number 1, item number 1 and was affirmed as a final order on June 27, 2023, with respect to a workplace located at 303 Sunset Dr, Rio, WI 53960.
