29 CFR  1910.178(l)(2)(ii):The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  a. Blume Construction, LLC at the worksite located at 12867 Road 82 in Latty, OH: On or about August 28, 2024, the employer did not ensure that employees who operated powered industrial vehicles (all-terrain forklifts/telehandlers) were adequately trained.  Unapproved and unsecured attachments exposed employees to tip-over and crushing injuries.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. Blume Construction, LLC at the worksite located at 12867 Road 82 in Latty, OH: On or about August 28, 2024, the employer did not ensure the scaffolding platform, used with the JLG all-terrain forklift (model G6-42A; s/n 0160047913) to provide a working surface and to lift building supplies via forklift, was designed by a qualified person.  Employees performing roofing operations from the platform were exposed to fall hazards of approximately 20 feet.   b. Blume Construction, LLC at the worksite located at 12867 Road 82 in Latty, OH: On or about August 28, 2024, the employer did not ensure the scaffolding platform, used with the Caterpillar all-terrain forklift (model TH63; s/n 5WM03436) to provide a working surface and to lift building supplies via forklift, was designed by a qualified person.  Employees performing roofing operations from the platform were exposed to fall hazards of approximately 20 feet. Blume Construction, LLC at the worksite located at 12867 Road 82 in Latty, OH: On or about August 28, 2024, employees performing roofing operations from a scaffold were exposed to falls of approximately 20 feet in that the scaffold was not equipped with a standard guardrail. Employees were exposed to falls at the open ends of the scaffold and while transitioning up to, and down from, the roof in that the front section of the scaffold was not equipped with a standard guardrail to protect from falls during movement.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
