Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) On or about the week of August 12, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin in the Assembly Area; an employee was exposed to fall hazards over 10 feet while accessing the tops of PDC units to install roofing panels without utilizing fall protection. b) On or about the week of July 29, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin; an employee was exposed to a fall hazard over 10 feet while covering a finished unit with a tarp in preparation for transport without utilizing fall protection.

29 CFR 1910.30(a)(1): Fall hazards. (1) Before any employee is exposed to a fall hazard, the employer must provide training for each employee who uses personal fall protection systems or who is required to be trained as specified elsewhere in this subpart. Employers must ensure employees are trained in the requirements of this paragraph on or before May 17, 2017: On or about September 18, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin; the employer did not ensure that each employee working from elevated surfaces were provided with the required fall protection training on the use of fall protection systems and the correct procedures for installing, inspecting, operating, maintaining and disassembling fall protection systems.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: a) On or about August 29, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin in the Assembly Department; the employer did not request that the Toyota electric forklift, Model No. 7FBEU20, Serial No. 12337, be marked to identify the front-end attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered when the forklift utilized manufactured six foot fork extensions. b) On or about August 29, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin in the Assembly Department; the employer did not request that the Toyota electric forklift, Model No. 7FBCU55, Serial No. 60300, be marked to identify the front-end attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered when the forklift utilized manufactured eight foot fork extensions.

The Toyota electric forklift, Model No. 7FBEU20, Serial No. 12337 utilized manufactured fork extensions. b) On or about August 29, 2024, at a workplace located at 202 Enterprise Road, Winneconne, Wisconsin in the Assembly Department; the employer utilized fork extensions which affect the capacity and safe operation of forklifts without manufacturer's prior written approval. The Toyota electric forklift, Model No. 7FBCU55, Serial No. 60300 utilized manufactured fork extensions.
