29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems. On or about August 28, 2024, and at times prior thereto, employees of a subcontractor were exposed to fall hazards while engaging in roofing work activities at heights greater than six feet without the use of fall protection. a.) On the roof of the drive-thru, employees of a subcontractor were working at heights greater than six feet without the use of fall protection. b.) On the roof of the main building, an employee of a subcontractor was working s at heights greater than six feet without the use of fall protection.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. On or about August 28, 2024, on the west side of the building near the drive-thru, employees of a subcontractor used two ladders to gain access to the roof and the side rails did not extend at least three feet above the upper landing surface.
