OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a)B&S Construction, LLC at 3612 Galt Court, Rapid City, SD 57701: On or about and at times prior to August 26, 2024 the exposing employer did not ensure employee performing roofing work were protected from impalement hazards in that rebar and similar materials used for temporary bracing were not removed after use. This condition exposed employees to impalement hazards. Among other methods, one feasible and acceptable abatement methods to correct this hazard include: Installing rebar caps or removing the rebar and similar materials to protect employees from impalement hazard.

29 CFR 1926.451(c)(2)(v):The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the fork and that the forklift was not moved horizontally while the platform was occupied: (a)B&S Construction, LLC at 3612 Galt Court, Rapid City, SD 57701: On or about and at times prior to August 26, 2024 the exposing employer did not ensure employees were protected from fall and struck-by hazards in that the platform used to lift materials and workers onto the roof of the pole barn was not appropriately secured to the Gehl RS5-34 telehandler. This condition exposed employees to fall and struck-by hazards. (b)B&S Construction, LLC at 3612 Galt Court, Rapid City, SD 57701: On or about and at times prior to August 26, 2024 the exposing employer did not ensure employees were protected from fall and struck-by hazards in that the Gehl RS5-34 telehandler was moved horizontally to allow workers to access and egress the roof of the pole barn. This condition exposed employees to fall and struck-by hazards.
