29 CFR 1926.760(a)(1):Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems: (a)Dean Kurtz Construction at 450 Concourse Drive, Rapid City, SD 57703: On or about and at times prior to August 27, 2024, the employer did not ensure employees were protected from fall hazards to the interior of the addition when working on the Southwest lower roof by use of an appropriate fall protection systems. This condition exposed employees to fall hazards in excess of 15 feet above a lower level.

29 CFR 1926.453(b)(2)(iv):Employees working in an aerial lift were not standing firmly on the floor of the basket: (a)Dean Kurtz Construction at 450 Concourse Drive, Rapid City, SD 57703: On or about and at times prior to August 27, 2024, the employer did not ensure employees working out of the JLG aerial lift stood firmly on the floor in that an employee climbed on the guardrail when performing work in the aerial lift. This condition exposed the employee to fall hazards.
