29 CFR 1926.501(b)(1):Employees on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level were not protected from falling by the use of guardrail systems, safety net systems, or personal fall protection system: (a)Connelly, Tiehen & Sons, Inc. at 4633 West Homefield Drive, Sioux Falls, SD 57106: On or about and at times prior to August 28, 2024, the employer did not ensure that employees working on the roof of the commercial building conducting framing operations were protected from fall hazards by use of an appropriate fall protection system. This condition exposed employees to fall hazards greater than six feet.

29 CFR 1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: (a)Connelly, Tiehen & Sons, Inc. at 4633 West Homefield Drive, Sioux Falls, SD 57106: On or about and at times prior to August 28, 2024, the employer did not ensure that employees working on the roof of the commercial building were protected from fall hazards in that an employee attached a Guardian Vertical Lifeline Assembly ("VLA") to a 2x4 temporary support by wrapping the fall arrestor extension lanyard around the 2x4 and clipping the fall arrestor snap hook to the rope lifeline. This configuration held the fall arrestor eyelet in the open position that could not arrest the rope lifeline in the event of a fall. This condition exposed an employee to fall hazards. (b)Connelly, Tiehen & Sons, Inc. at 4633 West Homefield Drive, Sioux Falls, SD 57106: On or about and at times prior to August 28, 2024, the employer did not ensure that employees working on the roof of the commercial building were protected from fall hazards in that an employee did not adjust the Guardian Vertical Lifeline Assembly ("VLA") fall arrestor to their work area to reduce the slack rope lifeline in the system. An employee was observed with excess slack rope lifeline that in conjunction with the shock absorber would not limit an employees free fall to not more than 6 feet in the event of a fall.

This condition exposed employees to fall hazards.
