29 CFR 1910.178(l)(2)(ii): Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. a) On or about August 25, 2024, the employer failed to provide employees with practical training and evaluations of the forklift operators performance. As a result, employees were exposed to struck-by and caught-between hazards while operating forklifts.

Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a) On or about August 25, 2024, the employer failed to report to OSHA within 24 hours the in-patient hospitalization of an employee who was injured in a caught-between incident involving a Crown RC5545-40 forklift and a wooden table.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a) On or about August 25, 2024, the employer failed to ensure that forklifts were examined before being placed in service each day. Specifically, employees operated the Crown RC5545-40 forklift without conducting the required daily inspections.
