On or about September 3, 2024, at an establishment located at 1545 University Avenue, Green Bay; the employer did not develop and utilize a powered industrial truck training program to cover truck-related topics and workplace-related topics exposing employees to struck by and caught in between hazards.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. On or about September 3, 2024, at an establishment located at 1545 University Avenue, Green Bay; the Komatsu gas powered forklift was not removed from service when found in need of repair due to a horn not working properly, no back up alarm, and no working lights exposing employees to struck by, crushing, and tip over hazards.

29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer. On or about September 3, 2024, at an establishment located at 1545 University Avenue, Green Bay; the employer did not ensure the seatbelt was reinstalled and utilized when removed on the Komatsu gas powered forklift when employees were driving in and out of the garage area exposing employees to tip over and crushing hazards.
