OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing hazards involving the movement of material with below-the-hook lifting devices: (a): On or about September 3, 2024, the employer did not ensure safe working conditions at the job site when employees utilized below-the-hook lifting devices, known as lift tongs. The lift tongs were not marked with the rated load capacity or location assigned, and employees were exposed to amputation and struck-by hazards as lift tongs were used to move equipment and material throughout the job site on Line #1 and Line #2 in department 256. (b): On or about September 17, 2024, the employer did not ensure safe working conditions at the job site when employees utilized below-the-hook lifting devices, known as lift tongs. The lift tongs were not marked with the rated load capacity or location assigned, and employees were exposed to amputation and struck-by hazards as lift tongs were used to move equipment and material throughout the job site on Line #3 in department 256. Among other methods, one feasible and acceptable method to correct this hazard is to follow the American Society of Mechanical Engineers - ASME B30.20 Below-the-Hook Lifting Devices, section 20-1.2.1, "Marking, Construction, and Installation," which states "All new structural and mechanical lifting devices shall be marked with, but not limited to, the following information: (1) manufacturer's name and address; (2) serial number; (3) lifter weight, if over 100 lb (45 kg); (4) cold current (amps) (when applicable); (5) rated voltage (when applicable); (6) rated load [as described in para. 20-1.2.1(a)]; (7) ASME BTH-1 Design Category; (8) ASME BTH-1 Service Class."
