29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: guardrail systems, safety net systems; or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) Boiler Room Mezzanine: On or about August 30, 2024, where employees were exposed to a fall hazard of approximately 8-10 feet while ascending or descending the roof access ladder that was adjacent to the guardrail system that measured approximately 42 inches in height.

1910.29(b)(13)(i): A guardrail opening did not have a self-closing gate that slides or swings away from the hole, and is equipped with a top rail and midrail or equivalent intermediate member that meets the requirements in paragraph (b) of this section: a) Boiler Room Mezzanine: On or about August 30, 2024, where the opening at the access point of the fixed ladder to the mezzanine was not equipped with a self-closing gate, exposing employees to a fall of approximately 8 feet to the lower level.
