29 CFR 1910.1200(f)(6):The employer used written materials, such as signs, placards, process sheets, or batch tickets in lieu of affixing labels to individual stationary process containers that failed to identify the container(s) to which they were applicable and did not convey the information required by 29 CFR 1910.1200(f)(5): a.) On or about September 3, 2024 and at times prior thereto, in the acid room, employees using waste containers containing acids and chloroform were not labeled with the name of chemical and potential hazards. b.) On or about September 3, 2024 and at times prior thereto, in the acid room fume hood #4, employees using glass containers containing xylene and acids were not labeled with the name of chemical and potential hazards. c.) On or about September 3, 2024 and at times prior thereto, in the acid room fume hood #5, employees using glass containers containing chlorinated solvents were not labeled with the name of chemical and potential hazards.

29 CFR 1910.1450(e)(3)(iii): The employer's Chemical Hygiene Plan did not include a requirement that fume hoods and other protective equipment functioned properly and did not include specific measures that would be taken to ensure proper and adequate performance of such equipment: a.) On or about September 3, 2024, the employer did not ensure fume hoods #4 and #5 and other protective equipment was functioning properly. This condition exposed employees to health hazards.
