29 CFR  1910.23(b)(10): The employer did not ensure any ladder with structural or other defects was immediately tagged "Dangerous: Do Not Use" or with similar language in accordance with 1910.145 and removed from service until repaired in accordance with 1910.22(d), or replaced.  Location: 78 Horseblock Road, Yaphank, NY 11980.  On or about 09/05/2024,  The employer did not tag or remove a damaged 16 feet Uline Rolling ladder that employees used to access merchandise from shelving racks.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.

29 CFR  1910.25(b)(1): The employer did not ensure handrails, stair rail systems, and guardrail systems were provided in accordance with 1910.28:   Location: 78 Horseblock Road, Yaphank, NY 11980.  On or about 09/05/2024,  The employer did not ensure there were handrails on the stairway used by the employee daily to access the mezzanine level to store auto parts and other merchandises.  Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19

29 CFR  1910.28(b)(1)(i):The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system:   Location: 78 Horseblock Road, Yaphank, NY 11980.  On or about 09/05/2024,  Employees who transfer auto parts on the mezzanine level at 11.5 feet above the ground were not protected from falling.  The mezzanine level had an open sided edge and was missing a guardrail system.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
