29 CFR 1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 micrograms/ cubic meter, calculated as an 8-hour TWA. On or about October 2, 2024, and at times prior, at the Batch House, an employee's personal 8-hour time-weighted average (8-Hr TWA) exposure to respirable crystalline silica was 91 ug/m3 during preventive maintenance duties. This exceeded the OSHA 8-Hr TWA PEL of 50 ug/m3 for respirable crystalline silica by 1.8 times. The sampling was for 398 minutes and the remaining unsampled time of 82 minutes was calculated as a period of zero exposure.

29 CFR 1910.1053(f)(1):The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible. On or about October 2, 2024, and at times prior, at the Batch House, sand and other raw materials were not well contained where process control, exhaust ventilation, and housekeeping was insufficient to prevent the accumulation of dust on the floor and other horizontal surfaces in order to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL.

29 CFR 1910.1053(h)(1): The employer allowed dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica and wet sweeping, HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure were feasible. On or about September 5, 2024, respirable crystalline silica-containing dust in the Batch House was removed from surfaces by dry methods such as shoveling and dry broom sweeping.
