29 CFR  1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s)   (a) On or about September 5, 2024, the employer did not perform frequent and regular inspections of the job site to ensure that hazardous conditions were identified and corrected. Hazards identified included, but were not limited to fall protection not installed and/or used properly, safety glasses, and ladders not extending three feet above the landing surface.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about September 5, 2024, at the jobsite located at 3001 17th Place, South Milwaukee WI 53172, the employer did not ensure employees installing shingles on a two-story residential home using a pneumatic nail gun used eye protection, exposing the employees to eye hazards from flying particles.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a) On or about September 5, 2024, at the jobsite located at 3001 17th Place, South Milwaukee WI 53172, employees installing new shingles were not using fall protection. This exposed employees to fall hazard of approximately 19 feet.
