29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns:   a. On or about September 6, 2024, an employee was not wearing a protective helmet where there was a possible danger of head injury from falling objects. Employees were performing framing operations and using nail gun(s) nine (9) feet, seven (7) inches above the main level of a residential home, exposing the employee below to struck-by hazards from fallings objects.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  a. On or about September 6, 2024, at the above addressed jobsite, employee(s) performing framing installation on the upper level 15 feet, four (4) inches above ground level, were not protected from falls, thereby exposing the employee(s) to fall hazards.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface which the ladder is used to gain access; or when such an extension is not possible because of the ladder's length, then the ladder shall secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that a ladder deflection under a load would, by itself, cause the ladder to slip off its support.    a. On or about September 6, 2024, the portable ladder used to access the upper framing platform did not extend at least three (3) feet above the upper landing surface nor was it secured at the top, thereby exposing employees to the hazards associated with falls.
