The rope slings being utilized on site were damaged and not removed from service. This condition exposed employees to struck-by hazards due to rope damage and failure.

29 CFR 1926.1203(d):The employer did not implement a written permit space program as required by the standard after it decided that employees it directs will enter a permit space: a)Heartland Tank Inc. at 21242 461st Avenue, Volga, SD 57071: On or about and at times prior to September 7, 2024, the employer did not ensure that a permit space program was written and implemented prior to employees entering the permit required confined space. As a result, two employees entered the oxygen deficient permit required confined space of a Harvestore Silo and died as a result. This condition exposed employees to hazards associated with permit required confined spaces such as but not limited to entering spaces with an oxygen deficient atmosphere as a result of nitrogen dioxide off-gassing.
