29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about September 5, 2024, in the parking lot of the worksite, the employer did not fully and properly implement Table 1 when an employee was cutting concrete with a handheld power saw that did not have the integrated water delivery system connected and the employee was not in use of respiratory protection.

On or about September 5, 2024 and at times prior thereto, in the parking lot of the worksite, an employee was using a handheld power saw to cut concrete and the employer did not establish a hazard communication program that included respirable crystalline silica.
