29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) On or before 9/9/2024, the employer did not ensure that the two trenches onsite were adequately protected from cave-in hazards. An employee was clearing away dirt from around the water main line in two trenches located next to each other. The trench to the north was 10 feet deep and 6 feet wide while the south trench was 10.5 feet deep and 4 feet wide. The trenches were equipped with modular trench boxes with protection only along the long sides, with the short sides exposed to vertical walls of sandy soil. The subcontractor employee was adjacent to a vertical dirt wall shoveling away material that had sloughed away from the wall. (b) On or before 9/10/2024, the employer, in an attempt to abate the hazards, sent an employee down into the north trench to hand dig while still being exposed to trench collapse hazards due to an inadequate protective system. The trench box had been equipped with one end plate that was too high from the bottom of the trench. The other end of the box was still not equipped with an end plate.

29 CFR 1926.652(g)(2): Excavations of earth material to a level greater than 2 feet (.61m) below the bottom of a shield was permitted: (a) On or before 9/9/2024, the employer did not ensure that both trenches, which ran parallel to each other, were equipped with shielding systems that sat no greater than two feet from the bottom of the trench. The south trench had a gap of three feet, while the north trench had a gap of two and a half feet. The soil was sand, type C. These conditions exposed employees to trench collapse hazards.

The ladder used by employees to access the trench was on an unprotected side of the trench, outside the area protected by the trench shield. This condition exposed employees to trench collapse hazards.
