29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person(s). a) At the site located at 403 Snapdragon Loop, Bradenton, FL 34212; on or about August 23, 2024, the employer did not ensure that a competent person conducted an inspection of the job site to identify heat related hazards and implement means to prevent heat-related illnesses. Employees were exposed to the hazard of high heat from the sun during the performance of their job duties, including removing shingles and wood, and replacing them. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 24?- 34? (75.2? to 93.2?) and a calculated heat index of 25?-37? (77 ? to 98.6?) while working outdoors for approximately 8-9 hours performing moderate to heavy manual labor and wearing a short sleeve shirt. Such exposures are likely to lead to the development of serious heat-related illnesses such as, but not limited to, heat cramps, heat stress, heat exhaustion, and heat stroke.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: a) On or about August 23, 2024, at the site located at 403 Snapdragon Loop, Bradenton, FL 34212, the employer did not train employees in the recognition and avoidance of heat related hazards. Employees were exposed to the hazard of high heat from the sun during the performance of their job duties, including the removal of old shingles and wood, and re-installation. The calculated Wet Bulb Globe Temperature (WBGT) ranged from 24?- 34? (75.2? to 93.2?) and a calculated heat index of 25?-37?
