OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion and fire hazards.  On or about September 11, 2024, at the Maysville Condensate Facility, employees were exposed to a fire and explosion hazards while performing pigging operations including flushing natural gas and natural gas condensate from the pipeline and into a frac tank with open top hatches. The work area around the frac tank accumulated flammable atmosphere and a flash fire occurred that burned three workers.  In the alternative:  1910.106(b)(6): In locations where flammable vapors may be present, precautions were not taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat; and, 1910.106(e)(2)(iii): Areas in which flammable liquids are transferred from one tank or container to another container adequate natural or mechanical ventilation was not provided.

29 CFR  1910.1200(f)(6)(ii):  Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  On or about September 11, 2024, at the Maysville condensate Facility, employees performing pigging operations were using a portable frac to transfer and collect natural gas condensate and the tank was not labeled to identify its contents.
